It is illegal to drive a vehicle under the influence of alcohol, prescription drugs, or illegal drugs. A vehicle includes a motor vehicle; a boat or jet ski; and all other means of transport that move on wheels.

For alcohol, the police use a breathalyser to test if you have any alcohol in your system. The breathalyser will show your blood alcohol concentration (BAC).  For drugs, the police use swaps to test whether you have any in your system.

If found with drugs or alcohol in your system while operating a vehicle, the severity of your penalty will depend on the below factors:

Drink Driving

 

Blood Alcohol Concentration (BAC)  Licence Disqualification Maximum Fine Maximum Prison Time
>0.00 but <0.05 (learner, probationary or provisional licences) 3 to 9 months $1,868 3 months
0.05 and over, but under 0.10 1 to 9 months $1,868 3 months

0.15 and over Min of 6 months $3,736 9 months

 

Drug Driving

The saliva test detects the active ingredient in the drug and depends on factors such as the:

  • type of drug taken
  • quantity and quality of drug
  • frequency of drug use
  • period of time since taking the drug.

 

PENALTIES

  • disqualify you from driving for between 1 to 9 months
  • fine you up to $1,868
  • impose a maximum term of imprisonment up to 3 months.

 A person convicted of driving under the influence of alcohol, cannabis, ecstasy or ICE may have grounds to apply for a work licence. However, this is not available if you have already had your driver’s licence suspended or cancelled in the previous five years.
