It is illegal to drive a vehicle under the influence of alcohol, prescription drugs, or illegal drugs. A vehicle includes a motor vehicle; a boat or jet ski; and all other means of transport that move on wheels.
For alcohol, the police use a breathalyser to test if you have any alcohol in your system. The breathalyser will show your blood alcohol concentration (BAC). For drugs, the police use swaps to test whether you have any in your system.
If found with drugs or alcohol in your system while operating a vehicle, the severity of your penalty will depend on the below factors:
The amount of alcohol/drugs in the blood
The individual’s traffic history
Circumstances surrounding the offence
|Blood Alcohol Concentration (BAC)||Licence Disqualification||Maximum Fine||Maximum Prison Time|
|>0.00 but <0.05 (learner, probationary or provisional licences)||3 to 9 months||$1,868||3 months|
|0.05 and over, but under 0.10||1 to 9 months||$1,868||3 months|
|0.10 and over, but under 0.15||3 to 12 months||$2,669||6 months|
