Most online quotes show you a professional fee and stop there. Searches, the PEXA fee and government registration still have to be paid and they are usually where the difference shows up. Here’s what is and isn’t included in our fixed fee:

We cannot guarantee an outcome, and no law firm honestly can. We do not guarantee that your finance will be approved, that the other side will settle on time, that a bank or government department will move at the speed we would like, or that a search will come back clean. What we guarantee is our own cost, our own responsiveness and our own conduct of the matter. Where something outside our control threatens your settlement, you will hear it from us early rather than on the day.

How a Queensland conveyance runs
Conveyancing is the legal work of transferring ownership of property from one person to another. In Queensland it covers reviewing and advising on the contract, checking the seller’s disclosure, ordering and reviewing searches, tracking the contract’s cooling-off, finance and inspection dates, adjusting rates and levies, and exchanging funds and title at settlement through PEXA.

How much does conveyancing cost in Queensland?
Our professional fee for a standard residential purchase is $2,346.30 including standard searches, GST and the PEXA settlement fee, and for a standard sale $1,246.30 including standard searches, GST, and the PEXA settlement fee. On top of that sit any additional searches, and government registration fees (applicable for a purchase only), which we itemise so you can see the complete figure before you commit. Transfer duty is separate again and is paid to the Queensland Revenue Office. We give you the whole number in writing rather than a headline price.
How long does conveyancing take in Queensland?
Most residential contracts in Queensland settle 30 to 60 days after signing, and the contract itself sets the date. Cooling-off runs for the first five business days, finance and building and pest dates usually fall in the first two to three weeks, and searches run alongside. If your contract has a shorter timeframe we will tell you at the outset whether it is achievable.
What is the cooling-off period in Queensland?
For most residential property contracts the buyer has a cooling-off period of five business days, ending at 5pm on the fifth business day after the buyer receives a copy of the signed contract. If you terminate within it, the seller may keep 0.25% of the purchase price. Cooling-off does not apply to property bought at auction, or to a contract formed on the day of an unsuccessful auction. We confirm your exact cooling-off date the moment we see the contract.
Do I need a solicitor to buy a house in Queensland, or can I use a conveyancer?
Queensland is different from some other states: only a solicitor can carry out conveyancing here. There is no separate licensed conveyancer profession in Queensland, so the work is always done by or under the supervision of a solicitor. The practical question is whether you want a firm that can also advise on the legal issues sitting behind the transaction, such as a deceased estate, a trust structure, a tax question or a dispute with the other side.
What's included in your fixed fee?
Contract review, special conditions, reasonable amendments and negotiation, tracking your cooling-off, finance and building and pest dates, the standard searches, liaison with your agent, broker and the other side, PEXA lodgement, settlement attendance and trust account handling of the funds. Reasonable settlement extensions are included too. The full list is set out above and repeated in your written quote.
Can you review my contract before I sign it?
Yes, and we would prefer to. Most of the risk in a property transaction is fixed at signature: the special conditions, the disclosure you were given, the finance and inspection dates and the cooling-off position. Send the contract through and we will tell you what is in it in plain English.
When do I pay, and how?
For a sale, our professional fee is generally paid at settlement, out of the settlement funds. For a purchase, we require $500 payment up front for searches and outlays, because we have to order them, and the balance of $1,846.30 is payable at settlement. Transfer duty must be paid at or before settlement, depending on the Contract. We set out the timing in your quote so nothing arrives unexpectedly.
What is transfer duty and will I have to pay it?
Transfer duty, still widely called stamp duty, is a Queensland government tax on property transfers. It is calculated on the purchase price or the property’s value, and there are concessions for people buying a home to live in and further concessions for first home buyers. Eligibility depends on price, property type and how long you intend to live there. We calculate your figure and check your concession eligibility as part of preparing your quote.
What searches do I actually need?
The standard set covers title, the registered plan, rates and water, and land tax. These are all included in our quoted figure. Depending on the property we may recommend others, for example a body corporate records search for a unit, a contaminated land search, or flood and planning searches. We tell you what each one costs and why it is worth doing before we order it.
What if my finance falls through or the building and pest report comes back badly?
That is exactly what those conditions are there for. If finance is refused or the inspection turns up something you are not prepared to accept, you generally have the right to terminate under the relevant clause, provided the notice is given properly and on time. Getting the timing and the wording right matters, so tell us as soon as you know and we will act on it before the date expires.
Can you handle an off-the-plan purchase, a deceased estate transfer or an SMSF purchase?
Yes, all of them. Off-the-plan contracts, sunset clauses, transfers out of a deceased estate, purchases in a company or trust, and SMSF purchases including the bare trust for a limited recourse borrowing arrangement are all handled in-house. These sit outside the standard fixed fee, so we quote them individually before starting.
What is the seller disclosure statement and does it apply to me?
Queensland introduced a mandatory seller disclosure regime for residential property. A seller must give the buyer a disclosure statement and prescribed certificates before the buyer signs the contract, and failing to do so can give the buyer a right to terminate. If you are selling, we prepare the disclosure for you. If you are buying, we check that what you were given was complete before you signed.
Will I need tax advice as well as legal advice?
Often, yes, particularly on an investment purchase or disposal, a commercial property, a new residential premises, or anything involving a trust, company or SMSF. GST, capital gains tax, income tax and land tax can all be in play. Our accountants can work on the same file as your conveyancer, so it is one conversation rather than two.
