Stealing
Anything moveable is capable of being stolen. The person must do so without consent and without intention of giving it back to the owner.

The penalty imposed is dependant on the value of the property stolen, and the offenders criminal history.

 

Receiving Tainted Property
Tainted property is defined as property which has been obtained by way of an act constituting an indictable offence. If you receive property with reason to believe the property is stolen you have committed a crime.

The penalty can range between 7 years and 14 years imprisonment depending on the circumstances.

 

Burglary
A person who breaks any part of a dwelling or premises, or opens by unlocking, pulling, pushing, lifting or any other means, intended to be close is guilty of burglary.

A premises includes –

  • a building or structure and a part of a building or structure other than a dwelling; and
  • a tent, caravan, or vehicle; and
  • any similar place.

The penalty for entering a dwelling of another with intent to commit an indicatable offence is 14 years imprisonment.

The penalty for entering a dwelling by means of any break is imprisonment for life.

If the burglary occurs at night time the penalty is further increased as

 

Robbery 
Robbery is where a person steals anything and immediately before or after the time of stealing it, uses or threatens to use actual violence to any person or property in order to obtain the thing being stolen.

The penalty for robbery is 14 years imprisonment.

The penalty for robbery with a dangerous or offensive weapon, or in company with 1 or more other person(s), or if immediately before or immediately after the time of the robbery, the offender wounds or uses any other personal violence to any person, the offender is liable to imprisonment for life.

 

Property is defined to include the following –

  • everything capable of being the subject of ownership
  • money
  • electrical or other energy, gas and water;
  • a plant
  • an animal
  • a thing produced by an animal
  • other property, real or personal, legal or equitable, including things in action and other intangible property.

 

Possible defences

  • Duress
  • No intent to commit crime
